Er’mias Mitchell’s death in July 2025, at Valleygate Dental Surgery Center gained public attention. The family has held protests outside the facility and at the Guilford County Courthouse. They have consistently argued that records contain inconsistencies between Valleygate documentation, EMS reports, hospital records, and the autopsy.
Earlier this month, the family’s attorneys publicly puahed the Guilford County DA’s office for a criminal investigation, citing the propofol dosing, vomiting between doses, alleged lack of informed consent regarding the anesthesia method, and communication failures.
The DA’s office has stated it reviewed the case, relies on the medical examiner’s findings, and is not moving forward with prosecution based on current information — but will review any new information.
The family has indicated plans to pursue civil action. The facility faced regulatory scrutiny after the death, including a state cease-and-desist on certain operations during an ongoing renovation.
